กฎหมาย พระราชบัญญัติป้องกันและปราบปรามการค้ามนุษย์ พ.ศ.๒๕๕๑

            มาตรา ๖ ผู้ใดกระทำการอย่างหนึ่งอย่างใด ดังต่อไปนี้

             (๑) เป็นธุระจัดหา ซื้อ ขาย จำหน่าย พามาจากหรือส่งไปยังที่ใด หน่วงเหนี่ยวกักขัง จัดให้อยู่อาศัย หรือรับไว้ซึ่งบุคคลใด โดยข่มขู่ ใช้กำลังบังคับ ลักพาตัว ฉ้อฉล หลอกลวง ใช้อำนาจโดยมิชอบ ใช้อำนาจครอบงำบุคคลด้วยเหตุที่อยู่ในภาวะอ่อนด้อยทางร่างกาย จิตใจ การศึกษา หรือทางอื่นใดโดยมิชอบ ขู่เข็ญว่าจะใช้กระบวนการทางกฎหมายโดยมิชอบ หรือโดยให้เงินหรือผลประโยชน์อย่างอื่นแก่ผู้ปกครองหรือผู้ดูแลบุคคลนั้นเพื่อให้ผู้ปกครองหรือผู้ดูแลให้ความยินยอมแก่ผู้กระทำความผิดในการแสวงหาประโยชน์จากบุคคลที่ตนดูแล หรือ

                  (๒) เป็นธุระจัดหา ซื้อ ขาย จำหน่าย พามาจากหรือส่งไปยังที่ใด หน่วงเหนี่ยวกักขังจัดให้อยู่อาศัย หรือรับไว้ซึ่งเด็ก

ถ้าการกระทำนั้นได้กระทำโดยมีความมุ่งหมายเพื่อเป็นการแสวงหาประโยชน์โดยมิชอบ ผู้นั้นกระทำความผิดฐานค้ามนุษย์

                  การแสวงหาประโยชน์โดยมิชอบตามวรรคหนึ่ง หมายความว่า การแสวงหาประโยชน์จากการค้าประเวณี การผลิตหรือเผยแพร่วัตถุหรือสื่อลามก การแสวงหาประโยชน์ทางเพศในรูปแบบอื่น การเอาคนลงเป็นทาสหรือให้มีฐานะคล้ายทาส การนำคนมาขอทาน การตัดอวัยวะเพื่อการค้า การบังคับใช้แรงงานหรือบริการตามมาตรา ๖/๑ หรือการอื่นใดที่คล้ายคลึงกันอันเป็นการขูดรีดบุคคลไม่ว่าบุคคลนั้นจะยินยอมหรือไม่ก็ตาม

Unofficial Translation

               Section 6 Whoever commits any of the following acts:
              (1) procures, buys, sells, distributes, brings from, or sends to any place, detains, confines, arranges for the accommodation of, or receives any person by threatening, using force, kidnapping, fraud, deceiving, abusing power, abusing power over a person due to physical, mental, educational, or other weaknesses, threatening to use legal procedures improperly, or by giving money or other benefits to the guardian or caregiver of that person for the guardian or caregiver to consent to the offender exploiting the person under his care, or
              (2) procures, buys, sells, distributes, brings from, or sends to any place, detains, confines, arranges for the accommodation of, or receives a child.
If such an act is committed to exploit the person, such person is guilty of human trafficking.

            Illegal exploitation under paragraph one means exploitation through prostitution, production or distribution of media or pornographic materials, exploitation of sexual exploitation in other forms, enslaving or enslaving people, bringing people to beg, and cutting off organs for trade. Forced labor or services under Section 6/1 or any similar acts that are exploitative towards a person regardless of whether that person consents or not.
