มาตรา ๓*ในพระราชบัญญัตินี้

         “พันธุ์พืช” หมายความว่า พันธุ์ หรือกลุ่มของพืชที่มีพันธุกรรมและลักษณะทางพฤกษศาสตร์เหมือนหรือคล้ายคลึงกันและมีคุณสมบัติเฉพาะตัวที่แตกต่างจากกลุ่มอื่นในพืชชนิดเดียวกันที่สามารถตรวจสอบได้

         “เมล็ดพันธุ์” หมายความว่า เมล็ด หรือส่วนหนึ่งส่วนใดของพืชที่ใช้เพาะปลูกหรือใช้ทำพันธุ์ เช่น ต้น ตอ หน่อ เหง้า กิ่ง แขนง ตา ราก หัว ดอก หรือผล

         “เมล็ดพันธุ์ควบคุม” หมายความว่า เมล็ดพันธุ์ที่รัฐมนตรีประกาศกำหนดให้เป็นเมล็ดพันธุ์ควบคุม

         “เมล็ดพันธุ์รับรอง” หมายความว่า เมล็ดพันธุ์ที่ได้ผ่านการทดสอบ ตรวจหรือวิเคราะห์คุณภาพหรือคุณสมบัติและอธิบดีออกหนังสือรับรองให้

        “พันธุ์พืชขึ้นทะเบียน” หมายความว่า พันธุ์พืชที่ผ่านการพิจารณาขึ้นทะเบียนและอธิบดีออกหนังสือรับรองให้

         “พันธุ์พืชรับรอง” หมายความว่า พันธุ์พืชขึ้นทะเบียนที่ผ่านการพิจารณารับรองให้เป็นพันธุ์พืชรับรองและอธิบดีออกหนังสือรับรองให้

         “พืชสงวน” หมายความว่า พืชที่รัฐมนตรีประกาศกำหนดให้เป็นพืชสงวน

         “พืชต้องห้าม” หมายความว่า พืชที่รัฐมนตรีประกาศกำหนดให้เป็นพืชต้องห้าม

         “พืชอนุรักษ์” หมายความว่า พืชชนิดที่กำหนดไว้ในบัญชีแนบท้ายอนุสัญญาว่าด้วยการค้าระหว่างประเทศซึ่งชนิดสัตว์ป่าและพืชป่าที่กำลังจะสูญพันธุ์ ซึ่งรัฐมนตรีประกาศกำหนดในราชกิจจานุเบกษา

        “การขยายพันธุ์เทียม” หมายความว่า การขยายพันธุ์ที่ไม่ใช่การขยายพันธุ์โดยธรรมชาติตามหลักเกณฑ์และวิธีการที่อธิบดีกำหนด

        “ฉลาก” หมายความรวมถึง รูป รอยประดิษฐ์ หรือข้อความใด ๆ อันแสดงไว้ที่ภาชนะบรรจุ

         “ภาชนะบรรจุ” หมายความว่า วัตถุใด ๆ ที่ใช้บรรจุหรือห่อหุ้มเมล็ดพันธุ์โดยเฉพาะ

        “รวบรวม” หมายความว่า รวบรวมเมล็ดพันธุ์เพื่อคัดเลือกหรือบรรจุในภาชนะบรรจุ

        “ขาย” หมายความว่า จำหน่าย จ่าย แจก หรือแลกเปลี่ยน ทั้งนี้ เพื่อประโยชน์ในการค้าและหมายความรวมถึงมีไว้เพื่อขาย

         “นำเข้า” หมายความว่า นำหรือสั่งเข้ามาในราชอาณาจักร

         “ส่งออก” หมายความว่า นำหรือส่งออกนอกราชอาณาจักร

         “นำผ่าน” หมายความว่า นำหรือส่งผ่านราชอาณาจักร โดยมีการขนถ่ายหรือเปลี่ยนยานพาหนะ

         “สถานที่” หมายความว่า ที่ อาคารหรือส่วนของอาคาร และหมายความรวมถึงบริเวณของสถานที่ด้วย

         “คณะกรรมการ” หมายความว่า คณะกรรมการพันธุ์พืช

         “พนักงานเจ้าหน้าที่” หมายความว่า ผู้ซึ่งรัฐมนตรีแต่งตั้งให้ปฏิบัติการตามพระราชบัญญัตินี้

         “อธิบดี” หมายความว่า อธิบดีกรมวิชาการเกษตร

         “รัฐมนตรี” หมายความว่า รัฐมนตรีผู้รักษาการตามพระราชบัญญัตินี้

          Section 3. In this Act:

          “Plant Variety” means a variety or a group of plants with identical or similar genotypes and phenotypes and a specific identifiable character different from other groups of plants in the same species.

         “Seed” means seed or part of the plant to be used for growing or propagation such as stalk, stump, bulb or shoot, rhizome, branch, twig, bud, root, tuber, flower, fruit, or seed.

         “Controlled seed” means seed prescribed by the Minister as controlled seed.

          “Certified seed” means a seed that has been tested, examined, or analyzed of the quality or characteristics and the Director-General has issued a certificate thereof;

         “Registered plant variety” means a plant variety that has been registered and issued a certificate therefore by the Director-General;

          “Certified plant variety” means a registered variety that has been certified as a certified plant variety and the Director-General has issued a certificate thereof;

          “Reserved Plant” means a plant prescribed by the Minister as a reserved plant;

           “Prohibited Plant” means a plant prescribed by the Minister as a prohibited plant. 

       “Conserved Plant” means plant species listed in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora prescribed by the Minister as conserved plant and published in the Government Gazette;

          “Artificial Propagation” means propagation that does not occur naturally following rules and procedures prescribed by the Director-General;

          “Label” includes any picture, imprint, or statement shown on a container; “Container" means any material used for packing or wrapping seed;

           “Collect” means to collect seeds for selection or packing in a container;

            “Sale” means to sell, distribute, give, or exchange. In this regard, it is for commercial purpose and includes possessing for sale.

            “Import” means to bring order into the Kingdom;

            “Export” means to take or send out of the Kingdom;

           “Transit” means bringing or sending through the Kingdom via unloading or a change of vehicle;

            “Premise” means the place, building, or part of the building and includes the site of the building;

            “Committee” means the Plant Variety Committee;

             “Competent Official” means a person appointed by the Minister for the execution of this Act;

              “Director-General” means the Director-General of the Department of Agriculture; “Minister” means the Minister having charge and control of the execution of this Act.

         มาตรา ๕ ให้รัฐมนตรีว่าการกระทรวงเกษตรและสหกรณ์รักษาการตามพระราชบัญญัตินี้ และให้มีอำนาจแต่งตั้งพนักงานเจ้าหน้าที่ ออกกฎกระทรวง กำหนดค่าธรรมเนียมไม่เกินอัตราท้ายพระราชบัญญัตินี้ ยกเว้นค่าธรรมเนียม และกำหนดกิจการอื่น และออกประกาศ เพื่อปฏิบัติการตามพระราชบัญญัตินี้

        กฎกระทรวงและประกาศนั้น เมื่อได้ประกาศในราชกิจจานุเบกษาแล้วให้ใช้บังคับได้*

            Section 5. The Minister of Agriculture and Co-operatives shall have powers and control of the execution of this Act and shall have the power to appoint competent officials, issue Ministerial Regulation prescribing fees not exceeding the rates annexed hereto, exempting fees and prescribing other activities, and issue Notifications for the execution of this Act.

           Such Ministerial Regulations and Notifications shall come into force upon their publication in the Government Gazette.

        มาตรา ๖*ให้มีคณะกรรมการคณะหนึ่งเรียกว่า “คณะกรรมการพันธุ์พืช” ประกอบด้วยปลัดกระทรวงเกษตรและสหกรณ์เป็นประธานกรรมการ อธิบดีกรมวิชาการเกษตร อธิบดีกรมส่งเสริมการเกษตร ผู้แทนกรมป่าไม้ ผู้แทนกรมศุลกากร และผู้ทรงคุณวุฒิซึ่งรัฐมนตรีแต่งตั้งอีกไม่เกินเก้าคนเป็นกรรมการ และผู้อำนวยการกองควบคุมพืชและวัสดุการเกษตรเป็นกรรมการและเลขานุการ

          Section 6. There shall be a committee called the "Plant Variety Committee" consisting of the Permanent Secretary of the Ministry of Agriculture and Co-operatives as Chairman, the Director-General of the Department of Agriculture, the Director-General of the Department of Agricultural Extension, a representative of the Royal Forest Department, a representative of the Customs Department and not more than nine qualified persons appointed by the Minister as members, and the Director of the Agricultural Regulatory Division as member and secretary.

         มาตรา ๘ กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งก่อนวาระ เมื่อ

         (๑) ตาย

         (๒) ลาออก

         (๓) รัฐมนตรีให้ออก

         (๔) เป็นบุคคลล้มละลาย

         (๕) เป็นคนไร้ความสามารถหรือเสมือนไร้ความสามารถ

          (๖) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้กระทำโดยประมาท หรือความผิดลหุโทษ

           เมื่อกรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งก่อนวาระรัฐมนตรีอาจแต่งตั้งผู้อื่นเป็นกรรมการแทนได้ และให้ผู้นั้นอยู่ในตำแหน่งตามวาระของกรรมการซึ่งตนแทน

         Section 8. A qualified member vacates office before the expiration of his or her term upon:

         (1) death;

         (2) designation;

         (3) being dismissed by the Minister;

         (4) being a bankrupt;

         (5) being an incompetent person or quasi-incompetent person;

         (6) having been imprisoned by a final judgment of imprisonment except that such punishment is for an offence committed through negligence or for a petty offence;

         If a qualified member vacates the office before the expiration of his or her term, the Minister may appoint another person to replace such member and that person shall be in office for the remaining term of office which he or she replaces.

           มาตรา ๙ การประชุมของคณะกรรมการต้องมีกรรมการมาประชุมไม่น้อยกว่ากึ่งจำนวนของกรรมการทั้งหมดจึงเป็นองค์ประชุม ถ้าประธานกรรมการไม่มาประชุม หรือไม่อาจปฏิบัติหน้าที่ได้ ให้กรรมการที่มาประชุมเลือกกรรมการคนหนึ่งเป็นประธานในที่ประชุม

           การวินิจฉัยชี้ขาดของที่ประชุม ให้ถือเสียงข้างมาก

           กรรมการคนหนึ่งให้มีเสียงหนึ่งในการลงคะแนน ถ้าคะแนนเสียงเท่ากัน ให้ประธานออกเสียงเพิ่มขึ้นอีกเสียงหนึ่งเป็นเสียงชี้ขาด

             Section 9. At a meeting of the Commission, the presence of not less than one-half of the total number of members is required to constitute a quorum.

            If the Chairperson is not present at the meeting or is unable to perform his or her duty, the members present shall elect one among themselves to preside over the meeting. 

           A decision of the meeting shall be by a majority of votes. Each member shall have one vote. In the case of an equality of votes, the presiding chairman shall have an additional vote as a casting vote.

         มาตรา ๑๐* ให้คณะกรรมการมีอำนาจแต่งตั้งคณะอนุกรรมการเพื่อพิจารณาศึกษา วิจัย หรือปฏิบัติการเกี่ยวกับพืชที่คณะกรรมการมอบหมาย และให้นำความในมาตรา ๙ มาใช้บังคับแก่การประชุมของคณะอนุกรรมการโดยอนุโลม

         Section 10. The Plant Variety Committee has the power to appoint a SubCommittee to study, research, and act upon any plant prescribed by the Plants Committee and the provision of section 9 shall apply mutatis mutandis to the Meeting of SubCommittee.

          มาตรา ๑  พระราชบัญญัตินี้เรียกว่า “พระราชบัญญัติสัญชาติ พ.ศ. ๒๕๐๘”

          Section 1. This Act is called the “Nationality Act, B.E. 2508 (1965)”.

          มาตรา ๒*  พระราชบัญญัตินี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป

         Section 2. This Act shall come into force as from the day following the date of its publication in the Government Gazette.

          มาตรา ๓  ให้ยกเลิก

         (๑) พระราชบัญญัติสัญชาติ พ.ศ. ๒๔๙๕

         (๒) พระราชบัญญัติสัญชาติ (ฉบับที่ ๒) พ.ศ. ๒๔๙๖

         (๓) พระราชบัญญัติสัญชาติ (ฉบับที่ ๓) พ.ศ. ๒๔๙๙

         (๔) พระราชบัญญัติสัญชาติ (ฉบับที่ ๔) พ.ศ. ๒๕๐๓

         (1) Nationality Act, B.E. 2495 (1952);

         (2) Nationality Act (No. 2), B.E. 2496 (1953);

         (3) Nationality Act (No. 3), B.E. 2499 (1956);

          (4) Nationality Act (No. 4) B.E. 2503 (1960).

          มาตรา ๔  ในพระราชบัญญัตินี้

          “คนต่างด้าว” หมายความว่า  ผู้ซึ่งมิได้มีสัญชาติไทย

          “คนไทยพลัดถิ่น”* หมายความว่า ผู้ซึ่งมีเชื้อสายไทยที่ต้องกลายเป็นคนในบังคับของประเทศอื่นโดยเหตุอันเกิดจากการเปลี่ยนแปลงอาณาเขตของราชอาณาจักรไทยในอดีตซึ่งปัจจุบันผู้นั้นมิได้ถือสัญชาติของประเทศอื่น และได้อพยพเข้ามาอยู่อาศัยในประเทศไทยเป็นระยะเวลาหนึ่งและมีวิถีชีวิตเป็นคนไทย โดยได้รับการสำรวจจัดทำทะเบียนตามกฎหมายว่าด้วยการทะเบียนราษฎรภายใต้หลักเกณฑ์และเงื่อนไขที่คณะรัฐมนตรีกำหนด หรือเป็นผู้ซึ่งมีลักษณะอื่นทำนองเดียวกันตามที่กำหนดในกฎกระทรวง

           “คณะกรรมการ”* หมายความว่า คณะกรรมการกลั่นกรองเกี่ยวกับสัญชาติ

           “พนักงานเจ้าหน้าที่” หมายความว่า ผู้ซึ่งรัฐมนตรีแต่งตั้งให้ปฏิบัติการตามพระราชบัญญัตินี้

          “รัฐมนตรี” หมายความว่า รัฐมนตรีผู้รักษาการตามพระราชบัญญัตินี้

          Section 4. In this Act,

          “Alien” means a person who does not have Thai nationality;

          “Displaced Thai”* means an ethnic Thai, who becomes a subject of another State due to changes in the territories of the Kingdom of Thailand in the past, but at present does not have a nationality of another country. He or she must immigrate into and reside in the Kingdom for a certain period and observe the Thai ways of life, as well as be verified and registered following the law on civil registration in conformity with criteria and conditions prescribed by the Council of Ministers; or possess other comparable characters outlined in Ministerial Regulation;

         “Committee”* means the Review Committee on Nationality;

          “competent official” means a person appointed by the Minister for the execution of this Act; 

         “Minister” means the Minister having charge and control of the execution of this Act.

           มาตรา ๕*  การได้สัญชาติไทยตามมาตรา ๙ มาตรา ๑๒ หรือมาตรา ๑๒/๑ การเสียสัญชาติไทยตามหมวด ๒ หรือการกลับคืนสัญชาติไทยตามหมวด ๓ ให้มีผลต่อเมื่อได้ประกาศในราชกิจจานุเบกษา และให้มีผลเฉพาะตัว

           Section 5.* The acquisition of Thai nationality under section 9, section 12, or section 12/1; the loss of Thai nationality under Chapter 2; or the resumption of Thai nationality under Chapter 3, shall be effective upon the publication in the Government Gazette and shall have an individual effect.

            มาตรา ๖*  ให้รัฐมนตรีว่าการกระทรวงมหาดไทยรักษาการตามพระราชบัญญัตินี้ และให้มีอำนาจแต่งตั้งพนักงานเจ้าหน้าที่กับออกกฎกระทรวงเพื่อปฏิบัติการตามพระราชบัญญัตินี้ และกำหนดค่าธรรมเนียมไม่เกินอัตราท้ายพระราชบัญญัตินี้ และยกเว้นค่าธรรมเนียมดังต่อไปนี้ให้ผู้ใดเป็นการทั่วไปหรือเฉพาะรายตามที่เห็นสมควร

          (๑) คำขอแปลงสัญชาติเป็นไทย

          (๒) หนังสือสำคัญการแปลงสัญชาติเป็นไทย

          (๓) คำขอกลับคืนสัญชาติไทย

           กฎกระทรวงนั้น เมื่อได้ประกาศในราชกิจจานุเบกษาแล้วให้ใช้บังคับได้

          Section 6.* The Minister of Interior shall have charge and control of the execution of this Act and shall have the power to appoint competent officials and issue Ministerial Regulation for the execution of this Act. He or she shall prescribe fees, not exceeding the rates annexed to this Act, and exempt fees for the following applications and documentations for any person either in general or as a specific case, as deemed appropriate:

         (1) application for naturalization as a Thai citizen;

         (2) certificate of naturalization as a Thai citizen;

         (3) application for resumption of Thai nationality.

          Such Ministerial Regulation shall become effective upon its publication in the Government Gazette.
